I confirm that the bug disappears after the fileout "PopUpInRightLayer.1.cs" is loaded.  So this looks like a good fix, and it also seems to be the "right thing to do".  It's possible that this subtle change in layering logic could adversely affect layering elsewhere in the user experience -- somewhere else in the image or off in some package the user may wish to load.  But probably not.
