I chalk this up to legislative stupidity. But they were certainly advised by 
lobbyists from the media organizations as to desired wording.

Still, doesn't it bother you that basic innovation -- for instance, making 
operating systems and programs -- would be legislated for the first time? 
That Linux, for instance, would have to include new crypto systems for the 
sake of copyright owners? That there would be yet another way to be sued or 
to become a criminal based on what amount to free speech?

Of course, there are many who want to say that software is not protected 
speech (the DMCA comes to mind).
