The model in this bill seems to be -- after they finally decide on something
-- that any and all new programs and devices must incorporate these security
methods. Even if the program runs under an operating system that already
provides those methods.
Note that the way it's written now, giving away Squeak as it stands would be
prohibited, since we "offer to the public" and "provide" "software" "that is
designed, marketed or used for the primary purpose of,
and that is capable of, storing, retrieving, processing, performing,
transmitting, receiving, or copying information in digital form."
I chalk this up to legislative stupidity. But they were certainly advised by
lobbyists from the media organizations as to desired wording.
Still, doesn't it bother you that basic innovation -- for instance, making
operating systems and programs -- would be legislated for the first time?
That Linux, for instance, would have to include new crypto systems for the
sake of copyright owners? That there would be yet another way to be sued or
to become a criminal based on what amount to free speech?
Of course, there are many who want to say that software is not protected
speech (the DMCA comes to mind).
