No, it's a feature. You can move it to the left or right side too. If you want it to stay where it is, open the halos, click on the menu (red circle) and select "resist being picked up".

Yes, what you both say is true in theory. In practice the docking bar lifts when you are trying to do other things in that area. It is uneven in that pressing a button does not lift the bar but pressing over an open area does. This is not the behavior one wants in a docking bar.
Even if it is sticky it can be lifted and moved to another edge by using the grab halo button. IMO it would be better for its default behavior to be sticky. The same menu trick would work in reverse if you wanted it to lift the way it does now.

Ah, okay. You're saying it should come locked in place out of the box. I think that would be okay, but I really think if we did that, we should make it obvious that it's designed to be movable. Maybe echo the halos locking option in one of the menus? (Microsoft does this with their taskbar, and I had no trouble figuring it out.)
